Terms and Conditions for C3 Customs.
1. Definitions
• “C3 Customs” refers to the custom fabrication business owned and operated by Chance Canary.
• “Customer” refers to any individual or entity engaging C3 Customs for services.
• “Products” refers to any custom-fabricated items, labor or service produced by C3 Customs.
• “Services” refers to the design, fabrication, and related activities performed by C3 Customs.
2. Scope of Work
C3 Customs will provide services as outlined in the project proposal or order form. Any changes to the scope of work must be agreed upon in writing by both parties.
3. Pricing and Payment
• Prices for products and services will be as quoted in the project proposal or order form.
• A non-refundable deposit of 50% is required to initiate work on any project.
•The remaining balance is due upon completion of the project, prior to delivery or installation.
- If paying with card customer agrees to pay the 3% fee on total invoice cost for transaction processing.
- Example- $100 x 1.03 = $103
- Late payments will incur a 1.5% interest charge per month.
4. Delivery and Installation
• Delivery dates are estimates and not guaranteed.
• C3 Customs is not responsible for delays caused by factors outside our control.
• Installation, if included, will be scheduled after full payment is received. Unless it is a build on site scope which payment will be due upon completion Unless explicitly specified differently In job contract.
5. Warranties and Limitations
• C3 Customs warrants that products will be free from defects in materials and workmanship for 1 year from the date of delivery.
• This warranty does not cover damage due to misuse, improper maintenance, or normal wear and tear.
• C3 Customs’ liability is limited to repair or replacement of defective products.
6. Intellectual Property
• All designs, drawings, and concepts created by C3 Customs remain the intellectual property of C3 Customs.
• Customers may not reproduce or use these designs without written permission.
7. Limitation of Liability
• C3 Customs’ total liability shall not exceed the amount paid for the products or services.
• C3 Customs is not liable for any indirect, incidental, or consequential damages.
8. Indemnification
The Customer agrees to indemnify and hold C3 Customs harmless from any claims, damages, or losses arising from the use or misuse of our products or services.
9. Termination
• Either party may terminate the agreement with 30 days’ written notice.
• The Customer is responsible for paying for all work completed up to the termination date.
10. Governing Law
This agreement shall be governed by the laws of the State of Alabama.
11. Dispute Resolution
Any disputes shall be resolved through binding arbitration.
12. Force Majeure
C3 Customs is not liable for failure to perform due to circumstances beyond our reasonable control.
13. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the project.
14. Modifications
These terms and conditions may be modified by C3 Customs at any time. The current version will always be available on our website.
15. Acceptance
By engaging C3 Customs for services or placing an order, the Customer automatically agrees to these terms and conditions.
